LAWRENCE, Kansas - A judge who struck down a Dover, Pennsyvania, school board's decision to teach intelligent design in public schools said he was stunned by the reaction, which included death threats and a week of protection from federal marshals.

Pennsylvania U.S. District Judge John E. Jones III told an audience in Lawrence Tuesday that the case illustrated why judges must issue rulings free of political whims or hopes of receiving a favor.

In a 139-page decision last year, Jones ruled that the Dover school board intended to promote religion when it instituted a policy requiring students to hear a statement about intelligent design before ninth-grade biology lessons on evolution. He ruled that it is unconstitutional to teach intelligent design as an alternative to evolution.

"And if you would have told me when I got on the bench four years ago that I would have death threats in a case like this as opposed to, for example, a crack cocaine case where I mete out a heavy sentence, I would have told you that you were crazy," he said. "But I did. And that's a sad statement."

Jones' ruling drew attention in Kansas, which was involved in a controversy over evolution last year, after the Kansas State Board of Education inserted criticisms of evolution into the state's science standards.

The judge spoke at the University of Kansas' Difficult Dialogues at The Commons series, which includes several speakers who will discuss the evolution and intelligent design debate.

Evolution says species change over time in response to environmental and genetic pressures, while intelligent design says life is too complex to have developed without a designer.

On Tuesday, Jones didn't focus on that debate but instead discussed the fallout, which included the death threats and a verbal lashing from conservative pundits around the country.

He said much of the criticism showed a lack of understanding about the role of judges, who he said should rule based on the Constitution and legal precedence - not on personal whims or political favors.

Jones said many people expected him to rule differently because he is a longtime Republican and was appointed by President Bush.

"These criticisms point at something in the way that both the pundits and the public tend to perceive judges," he said. "It is false, it is debilitating and if unchallenged, I believe it will ultimately tear at the fabric of our system of justice in the United States."

People have a right to disagree with judges, particularly by filing appeals, but the level of debate needs to rise above personal attacks, he said.

"As we spend time, as we did in the Dover case, debating what to put in the science curriculum in our schools, we had better start paying attention to the curriculum of civics and government, as well as history," he said.

C'mon, death threats...no way! These are God fearing peaceful people that we are talking about here, just ask them. I mean look at their past, isn't that the best predictor of the future. The Salem Witch trials, Inquisition, Crusades, Jimmy Swagart, Jim Baker. Look at all the young boys that were "reared" by the Catholics. They can attest to all the "good loving" they recieved by the hands of Christians. You people are dilusional, I know cause I had a vision and Jesus appeared to me. Well, it was either Jesus or a piece of toast...I'm not quite sure which? I prayed and God told me to sell it on Ebay. After I take out my shipping and handling charge (plus a small self interest fee, don't worry I prayed about it) the rest will be given as a "love offering" to my favorite Christian charity...the NRA. I gotta go now.

Btw, the Son of Sam (David Berkowitz) is now a Christian, so I will be seeing him in heaven. What a shame you carnal heathens won't be there. Go ahead and live a good life, what will that get you...nothing!

This article brought back a memory of a time when I was still walking around in my xtian coma. I was very active in the anti-abortion movement when a fellow activist approached me in the ladies room at church one day. It was right after that wackjob (can't remember his name) bombed an abortion clinic and killed a guard. When I expressed my disgust at the bomber's actions, my "friend" explained that the guard got what he deserved given that he was guarding an abortion clinic and the bomber was killing those people in defense of the unborn. That is when I realized that I was keeping company with dangerous, outta control, nutjobs! Even today, I feel strongly about the abortion issue BUT I think it is morally wrong to kill another human being no matter how well you try to justify it! I got the hell away from that crazy person and her entourage! I will probably see her on hte front page of the paper someday.

That is the mentality of fundamentalism, pure and simple! These people are so brainwashed and deluded that many so called "upstanding, pillars of the community" would resort to violence in defense of their warped beliefs! One thing I do not underestimate is the depths that a fundie will sink to defend their faith!

This is such a stupid non-issue!! It's perfectly legal to teach ID/Bible/etc. in the proper venues, i.e. Social Studies, Literature & History. I say let 'em because it will show the truth about what a morally bereft piece of plagarism the bible really is.

But ID is not, never was, never will be Science. It has no empirically testable hypothesis at its core, so it cannot (by definition) be science. Let the fundies beat their heads against that rock for as long as they like, it ain't gonna change.

Hey its a great idea to teach ID in school. Teach it from the Greek mythology texts, “In the beginning there was only chaos. Then out of the void appeared Erebus, the unknowable place where death dwells…Then Erebus slept with Night, who gave birth to Ether, the heavenly light, and to Day the earthly light…” I wonder, if it’s a problem not teaching the Christian version of ID, maybe they should teach the Islam creation story as well? I know, put all the wonderful mythical ID stories into a blender and serve up some kind of SUPER POOP drink for the kids in school!
