The pastor of a Bay Area church, four men in the aquarium industry and a commercial fisherman were indicted on federal charges of illegally catching and selling hundreds of juvenile leopard sharks, prosecutors said Wednesday.

The indictment charged Kevin Thompson, 48, pastor of the Bay Area Family Church in San Leandro, and the five others with selling 465 leopard sharks that were too small to harvest to pet distributors throughout the United States, the Netherlands and the United Kingdom.

California leopard sharks, which can take 13 years to reach maturity, live as long as 30 years and are protected under a state law that prohibits the commercial catching of specimens under 36 inches long. The indictment, which alleges that federal wildlife agents seized sharks ranging from 8 1/2-inches to 17 1/2-inches in length, was based on a federal statute that incorporates the state law.

The charges resulted from an investigation that followed the 2003 conviction of a pet distributor who was caught with more than a dozen leopard sharks from California, said Luke Macaulay, a spokesman in the U.S. Attorney’s Office in San Francisco.

The leopard shark’s gray body and black bars make it a “particularly attractive” species, said Christina Slager, a curator at the Monterey Bay Aquarium, which helped care for some of the confiscated fish. They are common along the California, Oregon and Baja California coasts and travel in schools, she said.

“In general sharks are struggling in the wild, and leopard sharks are no different,” Slager said. “If these animals aren’t allowed to reach an age or size where they can reproduce before they are removed from the environment, that has drastic implications for future generations.”

The other five defendants named in the indictment are: John Newberry, 34, of Hayward; Ira Gass, 53, of Azusa; Hiroshi Ishikawa, 36, of San Leandro, Vincent Ng, 43, of Oakland; and Sion Lim, 39, of San Francisco.

The six defendants were arrested on Tuesday, when the indictment was unsealed. Two pleaded not guilty. The Associated Press was unable to reach the other four. They face maximum penalties of five years in prison, a $250,000 fine and possible requirement to pay restitution for each count, according to the U.S. Attorney’s office.

“I can not believe that the federal government is charging these gentlemen with criminal activity,” said Jerome Matthews, a federal public defender representing Thompson.

Seven of the 19 baby leopard sharks confiscated during the two-year investigation died, the U.S. Attorney’s office said. Three are on exhibit at the Monterey Bay Aquarium, and nine were returned to the wild in the summer of 2004.

I know these idiots will only get a slap on the hand, but they could really get out of it scott-free by saying they were going to use the sharks in a tub for believers to test their religious faith by putting their hands in the tub while under the gift of the holy spirit. Using religion will always get special notice in a court of law, with sentences reduced and certain evidence overlooked. Religion the whitewashing of America.

Since christians believe that God will create a new heaven and a new earth they really don't think twice about killing sea creatures that are vital to the cycle of life in our oceans. Everyone in here knows their ultimate goal is to convert people in the end so they can come back home and tell pastor smith or whoever how many people they led to the "Lord". Trust me if I survived a natural disaster and I saw a bunch of self righteous bible thumping christians come to my aid with their blankets and "bibles" I would probably say THANKS but no THANKS. We all have seen christians in action and their ultimate goal almost every time in the end was to convert people. So don't hand us that BS. Remember we are exchristians and we know the true motivation behind their actions. I remember when hurricane Andrew hit and some people from my church at the time went down to help. I remember them coming back bragging about all the people they said the "sinners prayer" with. I'm not even sure if they truly helped anyone. Give me a break. If People want to help they are better off giving their money to a reputable humanitarian organization and not to a bunch of mind controlled missionaries. These people from New Orleans and the Tsunami need real help like construction workers, electricians, plumbers, nurses, doctors, etc. They need people who can truly help and not a bunch of christians whose only goal in the END is to convert them. Yeah Franklin Graham sent millions of tons of supplies over to Pakistan, a (complete muslim nation) the supplies were packaged wrapped with christian tracks, bibles, christian relics, jesus supplies, etc. I bet most of the supplies were burnt, even if it meant that they would starve or freeze to death, it would seem to them that it was more important that they receive jesus, than to survive there suffering.

I have family in New Orleans who lost everything. My Brother-in-Law went to a church in Houston for relief. The church lady (and I mean that in the most Dana Carvey way) informed him that New Orleans was destroyed by God for its wickedness in allowing gays to thrive in the city (something to that affect). He responded that the French Quarter (the area where most gays live in N.O.) was the part of the city that was spared. "Why is that?" he asked. He gave back the aid and left.

NO PRAYER FOR SOUP!

And what's with the hubris: "a bunch of spoiled 16 year olds..."? You're an asshole. Oh that's right, I forgot, a christian.

What a christian should do is ask someone, Have you ever heard of Jesus Christ? Then of course the answer will be, a resounding yes, then that should be the end of the conversation about religion or JC.

I personally want to hear about your humanitarian endeavors, and the career that you are putting on hold while you are building homes for the flood victims, and the salary cut you will be taking. You are an example for what all of us should be doing, and I would like to know about the sacrifices you are making for the poor and homeless.

Your overt rudeness illustrates and reinforces the general point made by many of these articles. Christianity does not magically change anyone's life. There is no mystical Holy Spirit sanctifying the Christian. It's all fake.

However, I will give you this: Christians do often become sanctimonious.

I have a degree, not in rhetoric - I can actually make a living with my degree. I did take some "critical thinking" courses, not an expert, but not your bitch.

First, I reject your assertion that I "have just blown your [my] own position out of the water!". There is really very little in the bible that means anything to me. To bible thumpers (whether you are just a coy fundamentalist christian, a pseudo-intellectual christian, or some asshole who just likes getting into arguments and not a christian at all, it really doesn't matter to me), the word of Gawd is the word of Gawd to the faithful. To know someone by their fruit means that a christian should act "christian like". Just because someone does not act "christian like" does not mean that they are not a "real" christian. Don't even start with the "well, they never had a REAL relationship with Jeeesssuusss". That is just "smoke and mirrors".

When I see someone with the title of Pastor or someone holding an "official" position in a church, that person is a christian to me (whether you want to believe it or not). It is my right to see it that way. It is only in your dillusional world that we all must obey the rules of "rhetoric". I am not on the Debate Team. What's tomorrow rule? "Roberts' Rule of Order"? "I hereby recognize the distinguished smug-ass troll from the bible belt..."

I standby my earlier statement that the bible sets-up the ultimate "strawman" scenario. When you see church officials (people who take salaries from their parishioners) who are not acting "christian like" then it does reflect on the group who identify themselves as "christians". I do not judge a man by the color of his skin, only by the "content of his character" (nod to Martin Luther King, Jr.). I hate having to cover my ass for you. No, I do not see Martin Luther King, Jr. as a "Good" Pastor, worthy of raising all of christendom to his level - I CHOOSE to see him as a Civil Righs Leader. Not for convenience sake, but for what he is really known for in the history of this country - sheeesh. I do not judge gay representatives who screw-up, or Black Panthers, or hippies, or Yippies, or flippin' Postal Employees. I really do judge based on an individual's character and not the group.

I DO judge the mis-deeds of Pastors and Church Employees. Why? Because they have a special priveledge in this country. It is because of their centuries of control over humankind. Women, gays, minorities, young people, old people, bikers, Hippies, Yippies, everyone has been "under their thumb".

I will keep this section short, I assure you that there are many examples, so here it goes:

1)They terrorize children - I know, I was one of them.

2)People who want to live out their lives with equality and the hope of the American Dream while being told that their "reward is in heaven" or that it really doesn't matter, because we are living in "the end times".

3)People who want to live their life in a way that is real for them (I'm talking about sexuality here), but will "burn in hell" for entertaining ideas (just the ideas, not even the acts) of "sins of the flesh". When you can control people's sexuality, especially their THOUGHTS of sexuality (George Orwell's Thought Police anyone?), then you really are controlling them.

I want you to understand me here - christianity is NOTHING MORE than a system of control. I WILL NOT stand around proclaiming how wonderful are the emporer's new clothes. Eventhough, that is what you are expected to do in this society.

The chrisian-wrong is tax exempt. It is in the George W. Bush White House. It is destroying the wonderful system of "checks and balances". It is making this country a theocracy. Joseph McCarthy couldn't do it, but DumbAss Dubya can. It dictates policy, talking points and legislation (they even want to Amend the Constitution to add some more "hate"). They can stand on there bullshit podiums and tell people how to vote - remember, they are tax exempt. They are destroying the planet and encouraging this administration- out-of-control not to worry about the planet because the Apocolypse is coming soon.

Here is your strawman: Anyone who represents any group not chrisian (biker, Hippies, Blacks, etc.) may be judged by their "fruit" based on the examples of a few (the Strawman), but.... Exchristians will be judged for providing evidence (which you claim that we do not have) regarding the fallacies of the control system by examples of many, many, many poor representatives (StrawMEN, if you will) of the controllers who call themselves christians. Not just ordinary, run-of-the-mill street "christians", but the paid from tax exempt funds, Christian LEADERS.

I gave money to Jim and Tammy Faye. I helped put an air conditioning unit on their dog house for them. Shove your christian leadership (I don't care if it is the Pope, Jerry Falwell, or the stupid Unification Pastor selling baby sharks) up your ass.

I sincerely hope that, in your mind, I am an angry 16 y.o. with teenage angst and that you hate me with all of your might. I am tired of trying to make myself acceptable to smug, self-righteous, egotistical, self-indulging, diarrhea-of-the-mouth, back-stabbing, spiffy clothes wearing, "get a haircut you loser hippy", gossiping, "you never had a true relationship with Jeeeeeessssussss", money grabbing, law-breaking, child-molesting control freak rapist, "women belong in the kitchen and were put on earth to serve their man", "a father must put Gawd ahead of his family", judgemental, myth believing, goddamned "christians" (whether you want to admit to being one or not).

I am going to New Orleans in two weeks to help re-build my former home city by spending my money at my favorite watering holes and reveling in the pagan ritual of Mardi Gras!
